This is a binding contract between You (“You” or “Your”) and High Tide Festival, LLC and Clean Tides Inc. (collectively, the “Company”).

5. Lineup Changes. Company reserves the right to change, modify, or substitute any performer or artist, their performance time, or the stage assignment at any time without notice. Such changes do not entitle You to a refund.
6. 21+ Policy. The Event is strictly for attendees aged 21 and over. You must present a valid, government-issued photo ID (Driver’s License, Passport, or Military ID) at the gate. Expired IDs, photocopies, or digital pictures of IDs will not be accepted.

9. Cashless Environment. The Event is a 100% cashless site. RFID wristbands will be the primary method for food, beverage, and merchandise transactions.
10. Replacement Fees. Company is not responsible for lost, stolen, or damaged wristbands. Replacement wristbands may be issued at "Customer Service" at the Company’s discretion for a non-refundable $25.00 USD replacement fee, provided the original purchaser presents a valid ID.
11. Unspent Funds. Any pre-loaded funds remaining on your RFID wristband after June 6, 2026, must be claimed via the official refund portal. The deadline for refund requests is June 20, 2026. Funds not claimed by this date are forfeited.

18. Prohibited Behavior. Harassment, violence, public intoxication, or any behavior deemed unsafe by security will result in immediate ejection without refund.
19. Health & Safety. You assume all risks related to exposure to communicable diseases (including COVID-19). You acknowledge that music festivals are high-decibel events and assume the risk of hearing damage.
20. General Liability. You waive, release, and hold harmless High Tide Festival, LLC, Clean Tides Inc., the City of North Charleston, and Riverfront Park from any and all claims for personal injury, property damage, or death arising from Your attendance at the Event.
21. Unforeseen Events. Company shall not be liable for failure to perform its obligations if such failure is the result of an Act of God (weather, fire, flood), government order, pandemic, riot, or any other event beyond the Company’s control. In such cases, Company may, at its sole discretion, reschedule the event or provide credit toward future events in lieu of a refund.
22. Governing Law. This Agreement is governed by the laws of the State of New York.
23. Binding Arbitration. Any dispute or claim relating in any way to Your Ticket or the Event will be resolved by binding arbitration, rather than in court. You and the Company both waive the right to a jury trial and the right to participate in a class-action lawsuit.
24. Jurisdiction. For any matter not subject to arbitration, or to enforce an arbitration award, You consent to the exclusive jurisdiction of the state and federal courts located in New York, NY.
25. Severability. If any part of this Agreement is found to be unenforceable, the remainder shall remain in full force and effect.
